Çocukların Korunması Hakkında Kanun

5395 sayılı Çocuk Koruma Kanunu, Türkiye'de korunmaya muhtaç veya suça sürüklenmiş çocukların haklarının güvence altına alınması ve sağlıklı bir şekilde gelişmeleri için kapsamlı bir yasal düzenleme getirmiştir. Bu kanun, çocukların temel hak ve özgürlüklerini korurken aynı zamanda onların toplumla uyumlu bireyler olarak yetişmelerine katkıda bulunmayı amaçlar.


Kanunun Amacı ve Kapsamı
Kanunun temel amacı, çocukların fiziksel, zihinsel, ahlaki, sosyal ve duygusal gelişimlerini tehdit eden her türlü durumdan korunmalarını sağlamak ve onlara gerekli desteği sunmaktır. Bu kapsamda, kanun;

• Korunma ihtiyacı olan çocuklar: İhmal edilen, istismar edilen veya suça maruz kalan çocuklar hakkında alınacak tedbirleri,
  
• Suça sürüklenen çocuklar: Suç işlediği iddia edilen veya suç işlediği gerekçesiyle hakkında güvenlik tedbiri uygulanan çocuklar hakkında alınacak tedbirleri,
  
• Çocuk mahkemelerinin görev ve yetkilerini düzenlemektedir.
  

Kanunda Yer Alan Önemli Kavramlar

• Korunma ihtiyacı olan çocuk: Bedensel, zihinsel, ahlaki, sosyal ve duygusal gelişimi ile kişisel güvenliği tehlikede olan, ihmal veya istismar edilen ya da suç mağduru çocuk.  
  
• Suça sürüklenen çocuk: Kanunlarda suç olarak tanımlanan bir fiili işlediği iddiası ile hakkında soruşturma veya kovuşturma yapılan ya da işlediği fiilden dolayı hakkında güvenlik tedbirine karar verilen çocuk.  
  
• Çocuk mahkemesi: Çocuklarla ilgili hukuki işlere bakan özel mahkemelerdir.
  

Kanunda Yer Alan Koruyucu Tedbirler

• Aileye destek hizmetleri: Çocuğun ailesine, çocuğun bakımı ve yetiştirilmesi konusunda destek verilmesi.
  
• Geçici bakım: Çocuğun güvenliği tehlikede olduğunda, bir süreliğine bir kurum veya uygun bir aile yanında bakılması.
  
• Kalıcı yerleştirme: Çocuğun kendi ailesine dönmesinin mümkün olmadığı durumlarda, evlat edinilmesi veya uygun bir aileye verilmesi.
  
• Tedavi ve rehabilitasyon: Çocuğun fiziksel, zihinsel veya duygusal sorunlarının giderilmesi için gerekli tedavi ve rehabilitasyon hizmetlerinin sunulması.
